Animal cruelty case sent to Carbon Court
A Towamensing Township couple accused of charges of cruelty to animals by neglect will have their case sent to Carbon County Court.
Gus Cerino and Shauna Andrews, of 1580 Strohl's Valley Road, Lehighton, faced a total of 28 animal cruelty charges when they went before District Judge Bruce Appleton of Palmerton on Tuesday.
But, defense attorneys claimed June Parker, a Humane Society Police Officer, wasn't officially sworn in when a search warrant was issued at the couple's property back in July when humane officers removed several horses and a pony from Cerino's property.
As a result, Appleton ruled for an open continuance so that the case could be sent to the county Court of Common Pleas.
This isn't the first controversy Cerino has found himself embroiled in.
In July, he was ordered by Appleton to pay the township $30,192 for illegally running a puppy mill at his property.
A civil judgment was entered, and a civil hearing held, before Appleton on July 15. On July 17, Appleton entered a judgment for the township against Cerino.
Cerino, according to court documents, was in violation of a township zoning ordinance because dogs were still being kept within 150 feet of a lot line.
In addition, Cerino was found to be in violation of another township zoning ordinance because he was using a building located to the east of his home to keep dogs in without having first applied for and obtained a zoning and building permit.
He also hadn't removed all but 29 of the dog runs, and had continued to erect dog runs without having first applied for and obtained a zoning and building permit, according to court documents.
Also at that time, Cerino was found to be in violation of the second enforcement notice because he hadn't applied for and obtained conditional approval as required by a section of the township zoning ordinance; hadn't applied for and obtained a zoning permit; hadn't landscaped all setbacks adjacent to the additional dog runs with visual screening and/or buffering; hadn't erected a solid barrier around the perimeter of the additional dog runs; hadn't erected a building to bring additional dogs into and keep them from 8 a.m. to 7 p.m.; hadn't submitted a land development plan for the additional dog runs; and had kept a dumpster for the disposal of animal waste approximately 80 feet away from an adjoining property line.
In Jan. of 2004, the township zoning officer sent Cerino an enforcement notice notifying him that he was in violation of several sections of the township zoning ordinance.
Then, in June of 2005, the zoning officer sent Cerino a second enforcement notice notifying him that he was in violation of several other sections of the zoning ordinance.
Cerino appealed both enforcement notices, with the exception that it permitted 29 dog runs or kennels to remain.
Cerino appealed that decision to the Court of Common Pleas of Carbon County, but the Honorable Judge David W. Addy affirmed the decision of the township's zoning hearing board.
As a result, Cerino then appealed to the Commonwealth Court of Pennsylvania, which in Oct. of 2007, affirmed the decision of the Court of Common Pleas.
Cerino then filed a Petition for Allowance of Appeal to the Supreme Court of Pennsylvania, which was denied. No further appeals were taken or attempted by Cerino.

I have been following the media regarding this I am appalled at how the Cerino's are being treated and all because of their neighbors having the power to control the Cerino's life. I purchased both of my dogs from their kennel on Strohls Valley and could not be happier with what they have. Where and when have the Cerino's been found guilty of having an "Illegal Puppy Mill"??? They are a state licensed kennel through The Department Of Agriculture and never been accused or charged of running an "illegal puppy mill" Sounds like a Libel and slander suit if you ask me. As for their horses, The Cerino's have opened their hearts and home to give those horses a permanent forever home since the horses all came from either a slaughter auction or because the owners no longer wanted them. I know for a fact that the horses were being taken care of and seen regularly by their Vet and all of the Cerino's animals have been looked at by the SPCA numerous times because of neighbor complaints and nothing was ever found wrong. In fact, SPCA will not go to the Cerino's any more because they feel the complaints are bogus and harrassment and stand by the Cerino's and approve of what they have and what they are doing. Go ahead check it for yourself. The SPCA was called by the Cerino's along with a Veterinarian who never had any dealings with the Cerino's to help with putting one of their horses down because that horse who was shuffled from auction to auction had an incurable disease that would eventually take her life but it was the Cerino's who vowed to do what they could to give that horse a feeling of being loved before she passed. I was there that day and could not believe how the neighbors created a feeding frenzy when no one and I mean no one really knew what was happening. The public was led to believe that animal cruelty did her in. "All things are NOT as they may appear" The neighbors apparently will do whatever it takes to chase the Cerino's out of their Strohls Valley. 2 words, "ORGANIZED CRIME!!!" And one more thing, To all the residents of Towamensing Township you better look closely at where your tax dollars are really going and how they are being used to try and destroy a good family and run them out of town because their neighbors have the power both politically and socially to do it. I have been visiting the Cerino's property with my 2 dogs every week for that last 2 years since obtaining pups and have seen many, many happy families leave with their new pups, I have seen people drop off animals because they know the Cerino's will take care of them and give them a good home, and I also have seen the neighbors scheme, plan, organize, find ways, use political power and other people with money whatever it will take and will not stop until the Cerino's are destructed. What if it was YOU being treated like this. Think about it. If you agree with the conspiracy then go ahead keep your money in your pocket and let the rest of us pay for your dirty work

I live near this family and spent an entire winter driving past the horses in question... While I completely understand giving horses a second opportunity and having faith that a sick animal will get better... the condition of the horses in question rapidly got worse! I literally drove past this place every day and saw these animals getting more and more emaciated! There is absolutely no excuse in the world for this! I have 2 horses of my own and have owned horses for most of my life... I had a 37 year old retired quarter horse that looked amazing until his last breath! It is completely inexcusable for the condition of the horses in that field! They should have been taken away and that family should face the most extreme charges for animal abuse, neglect, and cruelty! And further, they should not have the right to continue purchasing animals. How long will it take for someone to do something about the 2 horses they now have in the field??
I also drove in the winter. I noticed blankets on the horses. So , how could you tell they were emaciated. With blankets on them I find it hard to believe you could tell they were emaciated . So , I think you need to get a dictonary or stop f@#!$% lieing.
What the hell do your horses look like? I Guarentee you, the Cerino's horses looked as healthy as your old Quarter horse. Anybody with any horse knowledge and I mean ANY, could tell by the July news broadcast on that sleezy channel 13 , these horses were being taken care of . By the statements you made in your post , you don't know what it's like to take care of your own horses. I predict you board them somewhere . I wonder what they would look like if .... You had the opportunity to finally own your own horses that were auction left overs or old brood mares - or from people like yourself who had no more use for them. Stop assuming you know Everything. As for the 2 horses in the field now, mind your own damn business! I'm sure the Cerino's know what they're doing. If you have experience in horse care and drove by regularly, why didn't you stop in to see if you could help??? Maybe offer some suggestions or guidance. I also drive by there every day but I did choose to stop in to see if I could help with something. Shauna was a little defensive at first (understandibly so) but she was glad to take me to her horses and show me everything around her farm and kennel and explain what and how they take care of all the animals there . My only suggestion to her was to excercise the horses regularly to build muscle. She was very open and grateful for my help and advice and told me to please stop by at anytime. She really is a nice person and I could see by the way all of her farm animals follow her around that she loves them and takes care of them and they love her back . Just out of curiosity, do you know what breed of horses she had? And what kind are the two she has now? Maybe I'll just go take them too since you or I can take much better care of those horses than her. At least that's what we assume. How sad is that ? Come on, you don't have to have 30 years horse experience like you and I do to have horses or any animal for that fact. It is the responsibilty that counts. One more thing, How dare you question them being a "truly good family" Do you personally know them? No one has the right to say anything about someone until they know personally and for a fact... Do you think you have a "Truly good family?"
I want to publically thank everyone for their phone calls and visits in our support. It means the world to us that so many of you who actually know us are standing behind us and will testify in court on our behalf regarding us and all of our animals we have on our farm. Our Veterinarian is on our farm every 5-6 weeks to look at each animal we have and provide any medical treatment if necessary. Since we are a PA state licensed kennel since 1978 continuously holding a commercial K-5 license entitling us to a minumum of 251+ dogs per year we get inspected unannounced and by surprise about every 4-5 weeks by 2 supervisors and 3 officers of the Department of Agriculture Bureau of Dog law which equals about 8-10 times per year. The Officers see everything we have and inspect us with a fine tooth comb. The only problems they find is that our dogs chew the wood rendering the wood unsealed at the chew marks, the concrete is unsealed in some spots due to daily cleaning and sanitizing, and some hair when our dogs are shedding. The law states that all surfaces "must be made non-porous and readily sanitized " to prevent any bacteria or disease to enter any surface or come into contact with dog and "All hair, dirt, debris must me removed on a daily basis" Since our dogs are outside, they maintain a thicker fur than your household dog and our Husky's and malamutes blow their coats profusely where we ca't keep our place hair free. We also have all AKC dogs so AKC inspects us randomly with their own laws, rules and regulations. We take pride in our business and have provided thousands of families across the United States and Puerto Rico with beautiful, healthy pups with many of them holding championship titles in the AKC show circuit, Sled dog teams, Agility champs, Service dogs for the blind, handicapped or in public areas, guard dogs with police forces, military, business and families, hunting and tracking. Our farm is completely open to anyone who like to visit and we have nothing to hide. Our Customers choose our pups because of how we are and keep our animals. We have never been accused or found guilty of being an "Illegal Puppy Mill" so the media along with the public needs to stop accusing or we will be forced to start slander, libel, harrassment charges against those who do not know what they are talking about or have no proof. As for our horses, The SPCA has visited us 5 times in the last 1 1/2 years and have found us to be completely innocent of any neglect and have placed in their system that if any complaint comes in it is from a person who has the intent to harm. Our horses were under constant vet care and monitored every 5-6 weeks while on property and the horses where just placed on a strict feeding program designed by a hired equine nutrionist just 3 weeks prior to another humane organization who organized and planned the seizure along with a few of our neighbors and their friend who has political pull and is serving in an office in the Carbon County Court House to obtain a search warrant illegally to seize horses in the hopes of us surrendering the horses or face bogus animal cruelty charges, fines and restitution and finally closing our kennel down since closing the kennel has been unsuccessful and resulting in thousands of taxpayers dollars for legal fees and will continue to go through any roof especially with the Federal Lawsuit we have filed against the Towamensing Township. If you want to know what is really going on with our farm and all animals on it, you are welcome to stop in for a tour so that you can see for yourself and then base your own opinion on what you actually know first hand instead of accusations or rumours spred by other people who assume or intentionally try to harm us. We have had several people stop to offer suggestions or guidance with our horses and have accepted help in any way we can. Anyone who really knows me or Gus personally knows that we have never and will never negelct any of our animals both currently or in the past. I have always been and will remain an animal lover and have my whole lifetime along the my Vet relationship of experience in care no matter what type of animal I have and if I don't have experience in a certain animal, I research it and look for any professional or personal knowledgable person for help and guidance. With this being said, I urge you the please get to know us and our animals and speak the truth and do not respond with your opinions based on rumours, hear say, or anything other non truth words or sources because you are including yourself, your family and your friends into a web of deceit, lies, prejudice which is not the way a human should behave towards other humans if their intent is to harm... We do have the SPCA, Dog Law Bureau, friends, family, customers along with professional people and just people who want to help support us and will back us up. Just because you see something that does not look right does not mean it is wrong. For a community to succeed and prosper we need to work together and not against by stopping in and intruduce yourself as a new friend, ask questions about what you aren't comfortable with and offer help or guidance if you can in any way to become "neighborly" please do not let your children and families be raised with such personal standards. We just ask you to meet us and then hate us or like us. The choice is yours. We really are a wonderful family to know and we will always help whomever we can.
